Menéndez y Rubio Presentan Proyecto de Ley que Exige al Régimen Cubano la Extradición de Prófugos y Terroristas Estadounidenses

WASHINGTON – El senador Bob Menéndez (D-N.J.), presidente del Comité de Relaciones Exteriores en el Senado, hoy fue acompañado por el senador Marco Rubio (R-Fla.), miembro de más alto rango del Subcomité sobre el Hemisferio Occidental en presentar el proyecto de ley de Justicia para el Policía Werner Foerster y Frank Connor. La propuesta bipartidista establece como política oficial de Estados Unidos el requisito de extradición inmediata de todos los prófugos de la justicia que actualmente reciben refugio en Cuba para evitar su procesamiento o confinamiento por delitos cometidos en Estados Unidos. Entre los más de 70 fugitivos que se cree están recibiendo refugio en Cuba se encuentran criminales condenados como Joanne Chesimard y William Morales, cuyos delitos provocaron la muerte de dos residentes de Nueva Jersey. Otros prófugos acogidos por el régimen cubano incluyen personas acusadas de delitos de secuestro, asesinato, y otras ofensas relacionadas con drogas.

El nuevo proyecto de ley también requiere que el gobierno de Estados Unidos proactivamente tome cartas sobre los fugitivos con el gobierno cubano e implemente medidas adicionales para garantizar que Cuba no viole sus obligaciones en virtud de los tratados bilaterales existentes con respecto a la extradición. La legislación también exige una mayor transparencia sobre el número total de fugitivos estadounidenses en Cuba y los esfuerzos del Departamento de Estado para conseguir su extradición, y prohíbe el uso de cualquier tipo de asistencia externa para cualquier tipo de cooperación policial en Cuba hasta que el gobierno cumpla con sus obligaciones del tratado de extradición y devuelva a los fugitivos estadounidenses.

“Es completamente inaceptable que el régimen cubano siga ofreciendo refugio a criminales responsables de cometer actos atroces en Estados Unidos, incluyendo atentados terroristas, asesinatos de policías estadounidenses, secuestros de aviones y tráfico de armas”, dijo el senador Menéndez. “Las familias de las víctimas de estos fugitivos, incluyendo muchas en el estado de Nueva Jersey, han pasado décadas sin poder lograr una resolución y ver que se haga justicia como resultado directo de las acciones del régimen cubano. Este proyecto de ley enviará un fuerte mensaje a estas familias de que el gobierno de los Estados Unidos no ha olvidado su sufrimiento, y asegurará que la cuestión de los fugitivos estadounidenses siga siendo una prioridad máxima para la política de los Estados Unidos hacia Cuba”.

“El régimen comunista en Cuba le ha brindado refugio a Joanne Chesimard, Guillermo Morales, Charlie Hill, Víctor Manuel Gerena y otros criminales responsables de planificar y ejecutar crímenes violentos en contra de estadounidenses. Al hacer esto, el régimen les ha robado justicia a múltiples víctimas y sus familiares”, dijo el senador Rubio. “Esta legislación da un paso importante al exigir que el Secretario de Estado y el Fiscal General utilicen herramientas diplomáticas para asegurar la extradición de todos los fugitivos que residen en Cuba para enfrentar la justicia en EE.UU. Hasta que el régimen entregue a estos fugitivos para que sean juzgados en los tribunales de nuestro país, Cuba no debería recibir asistencia de los contribuyentes americanos ni alivio de sanciones”.

“Hace décadas, le prometí a mi madre Mary Connor Tully que lograríamos que se hiciera justicia con el fugitivo convicto William Morales que, junto con sus cómplices terroristas del FALN, asesinó a su primer amor, mi padre Frank Connor”, dijo Joseph Connor, hijo de Frank Connor quien fuera asesinado en 1977 por terroristas del FALN que actualmente reciben amparo por el régimen cubano. “El proyecto de ley de Justicia para el Policía Werner Foerster y Frank Connor puede convertir esta promesa en una realidad. Le rogamos a Estados Unidos que utilice todos los recursos disponibles para traer de regreso a Morales y a todos los terroristas y criminales de Cuba para que por fin se enfrenten a la justicia”.

En mayo de 1973, Joanne Chesimard y dos cómplices ejecutaron al policía estatal de Nueva Jersey Werner Foerster durante una parada de tráfico rutinaria. Aunque Chesimard fue juzgada, condenada y sentenciada a prisión, se escapó de una prisión de Nueva Jersey el 2 de noviembre de 1979 y actualmente está prófuga en Cuba. En 2013, Chesimard fue incluida en la lista de los terroristas más buscados del Buró Federal de Investigaciones (FBI, por sus siglas en inglés).

William Morales, líder y principal fabricante de bombas de la organización terrorista FALN, cometió numerosos atentados terroristas en los Estados Unidos, incluyendo los atentados contra la Taberna Fraunces en el bajo Manhattan en 1975 y la oficina de empleo de Mobil Oil en Nueva York en 1977, en los que murieron cinco personas, entre ellas Frank Connor, de Fair Lawn, Nueva Jersey, y resultaron heridas más de 60 personas.

Menendez, Rubio Introduce Legislation Demanding Cuban Regime Extradite American Fugitives, Terrorists

WASHINGTON –  U.S. Senator Bob Menendez (D-N.J.), Chairman of the Senate Foreign Relations Committee, was joined today by Senator Marco Rubio (R-Fla.) in introducing the Trooper Werner Foerster and Frank Connor Justice Act.  The bipartisan legislation defines U.S. policy to require the immediate extradition or return of all fugitives from justice currently receiving safe haven in Cuba to avoid prosecution or confinement for criminal offenses committed in the United States. Among the more than 70 fugitives believed to be receiving safe haven in Cuba are convicted felons Joanne Chesimard and William Morales, whose crimes led to the death of two New Jersey residents. Other fugitives being harbored by the Cuban regime include individuals charged with offenses ranging from hijacking to kidnapping to drug offenses and murder.

The new legislation also requires the U.S. government to actively raise the issues of fugitives with the Cuban government and take additional steps to ensure Cuba does not violate its obligations under existing bilateral extradition treaties. The legislation also requires increased transparency over the total number of U.S. fugitives in Cuba and State Department efforts to secure their extradition, and prohibits the use of any foreign assistance for law enforcement cooperation in Cuba until the country complies with its extradition treaty obligations and returns U.S. fugitives.

“It is unacceptable that the Cuban regime continues to harbor criminals responsible for committing heinous acts in the United States, including terrorist bombings, murdering American police officers, hijacking planes, and trafficking arms,” said Chairman Menendez. “The families of the victims of these fugitives, including many in my home state of New Jersey, have spent decades unable to find closure and see justice done as a direct result of the Cuban regime’s actions. This bill will send a strong message to these families that the United States government has not forgotten their plight, and it will ensure that the issue of American fugitives remains a top priority for U.S. policy towards Cuba.”   

“The communist regime in Cuba has provided safe haven to Joanne Chesimard, Guillermo Morales, Charlie Hill, Victor Manuel Gerena and other criminals responsible for planning and carrying out violent crimes against Americans,” said Senator Rubio. “By doing so, the regime has robbed these victims and their families of justice. This bill takes an important step by requiring the Secretary of State and the Attorney General to use diplomatic tools to secure the extradition of all fugitives residing in Cuba to face justice in the United States. Until the regime hands these fugitives over to face trial in American courts, it absolutely should not receive taxpayer assistance or sanctions relief.”

“Decades ago, I promised my mom Mary Connor Tully that we would bring justice to convicted fugitive William Morales who, along with his FALN terrorist comrades, murdered her first love, my father Frank Connor,” said Joseph Connor, son of Frank Connor who was killed in 1977 by FALN terrorists currently being harbored by the Cuban regime. “The Trooper Werner Foerster and Frank Connor Justice Act can make that promise a reality.  We implore the United States to use all resources available to bring Morales and all terrorists and criminals back from Cuba to face justice.”

In May 1973, Joanne Chesimard and two accomplices executed New Jersey State Trooper Werner Foerster during a routine traffic stop. Although Chesimard was tried, convicted and sentenced to imprisonment, she escaped from a New Jersey prison on November 2, 1979 and is currently a fugitive in Cuba. In 2013, Chesimard was added to the Federal Bureau of Investigation’s (FBI) Most Wanted Terrorists list.

William Morales, leader and chief bomb-maker for the terrorist organization FALN, committed numerous terrorist attacks on United States soil, including the bombings of Fraunces Tavern in lower Manhattan in 1975 and the Mobil Oil employment office in New York in 1977, which killed five people, including Frank Connor of Fair Lawn, N.J., and injured over 60 others.
